The materials contained in this platform are protected by applicable copyright and trademark law.

2. Use License

Permission is granted to temporarily access and use Vagary Voice's API and services for personal or commercial purposes, subject to the restrictions in these Terms of Service. This license shall automatically terminate if you violate any of these restrictions and may be terminated by Vagary Voice at any time. Upon termination, you must destroy any downloaded materials in your possession.

3. Prohibited Uses

You may not use our services for any illegal purpose or to violate any laws. You may not attempt to probe, scan, or test the vulnerability of the system. You may not use our services to transmit harmful, offensive, or objectionable content. You may not attempt to interfere with the proper working of the platform or circumvent security measures.

4. Billing and Payments

You agree to pay all fees associated with your use of our services. Fees are non-refundable except as required by law or as explicitly stated in these terms. We reserve the right to change our prices with reasonable notice. Failure to pay may result in suspension or termination of your account.

5. Disclaimer

The materials and services are provided on an 'as is' basis. Vagary Voice makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

6. Modifications

Vagary Voice may revise these Terms of Service at any time without notice. By using this platform you are agreeing to be bound by the then current version of these terms. We will make reasonable efforts to notify users of significant changes, but it is your responsibility to review these terms periodically.

Additional Terms

Service Level Agreement

  • We target 99.9% uptime for our API services
  • Scheduled maintenance windows will be communicated in advance
  • Enterprise customers may negotiate custom SLA terms
  • Credits may be provided for extended outages as specified in your plan

Intellectual Property

  • You retain ownership of your content and data
  • Vagary Voice retains ownership of all platform technology
  • You grant us a license to process your data to provide services
  • Feedback and suggestions may be used to improve our services

Limitation of Liability

  • Liability is limited to fees paid in the preceding 12 months
  • We are not liable for indirect, incidental, or consequential damages
  • This limitation applies to the fullest extent permitted by law
  • Some jurisdictions do not allow these limitations, which may not apply to you

Termination

  • Either party may terminate with 30 days written notice
  • We may terminate immediately for violation of these terms
  • Upon termination, you may export your data within 30 days
  • Certain provisions survive termination as specified herein

Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, unless you are located in a jurisdiction where arbitration is not permitted.
